On November 27, 2023, the Council of the European Union adopted The Regulation on harmonised rules on fair access to and use of data – commonly known as the Data Act. The Data Act entered into force on January 11, 2024, and will become directly applicable in all EU Member States from September 12, 2025, following a 20-month transitional period. Its objective is to facilitate data usage across sectors and promote innovation.​

The Data Act governs data sharing between consumers and businesses (B2C), as well as between businesses (B2B), obliges data holders to make data available, prohibits unfair contractual terms, and establishes clear rules for switching cloud providers and ensuring data availability in emergencies (B2G). Additionally, it addresses key responsibilities such as access to and use of data by public authorities, the development of technical infrastructures, and the promotion of interoperability through common European data spaces.​
